Terms of Service

Article 1 (Scope)

These Terms of Service (the "Terms") define the conditions for using Phonography (the "Service"). All users of the Service (the "Users") shall use the Service in accordance with these Terms.

Article 2 (Registration)

If registration is required for certain features of the Service, Users shall provide true and accurate information. Users must promptly update their registered information whenever changes occur.

Article 3 (Prohibited Conduct)

Users shall not engage in any of the following acts:

Article 4 (User Content)

In these Terms, "User Content" means any information that a User posts, uploads, or registers on the Service, including recorded audio, photos and cover images, titles, descriptions, addresses, latitude and longitude and other location data, and metadata such as the recording date and time.

Copyright and other rights in User Content belong, in principle, to the User who posted the content or to the legitimate rights holder.

The User grants the Service a royalty-free, non-exclusive, worldwide license to store, convert (including format conversion, compression, waveform generation, and thumbnail generation), reproduce, publish, transmit, distribute, and display the User Content, to the extent necessary to provide, operate, improve, and promote the Service. This license terminates after a reasonable period necessary to complete the suspension or deletion of the content (except to the extent required by legal retention obligations, backups, and similar needs).

The User represents and warrants that they lawfully hold the copyrights and other intellectual property rights, the rights concerning the portrait and privacy of subjects and other relevant persons, and the permissions necessary for recording, filming, and publishing, that are required to post the User Content.

Article 5 (Prohibited Conduct Regarding User Content)

In addition to the matters set forth in the preceding Article, Users shall not engage in, or create a risk of, any of the following acts when posting User Content:

Article 6 (Disclosure of Location Information)

When a User sets User Content to public, the precise location of the recording (including latitude, longitude, and address) may be disclosed to an unspecified number of third parties, including other users of the Service. Users shall take due care, at their own responsibility, not to publish information about their home, workplace, or other locations they do not wish to reveal.

Article 7 (Reporting, Content Removal, and Suspension)

If the Service determines that User Content violates, or may violate, these Terms or applicable laws, or upon receiving a report from another User, the Service may, without prior notice, hide or delete the content or take other necessary measures.

If a User violates these Terms, the Service may, without prior notice, suspend the User's use of the Service, suspend or delete the User's account, or take other necessary measures.

If a User finds content on the Service that violates these Terms or applicable laws, the User may report it to the Service through the in-app reporting feature or the contact address at the end of these Terms.

Article 8 (Claims of Rights Infringement)

Any person who believes that their copyright, portrait right, privacy right, or other rights are being infringed by User Content may contact the Service at the contact address at the end of these Terms, providing information that identifies the content in question and the nature of the infringement. After reviewing the matter, the Service will delete the content or take other appropriate action if it deems necessary.

Article 9 (Making User Content Private or Deleting It)

Users may, at any time and using the app's features, switch User Content they have posted to private or delete it.

Even after making content private or deleting it, due to caching, CDNs, search indexes, or other technical factors, it may take some time before the content can no longer be viewed from third-party environments. The Service does not guarantee deletion of information that has already been obtained, stored, or redistributed by third parties.

Article 10 (Suspension of Service)

The Service may suspend or interrupt all or part of the Service without prior notice due to system maintenance, failures, natural disasters, or other unavoidable reasons.

Article 11 (Intellectual Property)

Intellectual property rights related to the Service, including content, programs, logos, text, and images, belong to the Service or legitimate rights holders. Users shall not reproduce, republish, or modify such materials without authorization.

Article 12 (Disclaimer)

The Service does not guarantee that the Service is free from defects in fact or law, including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security.

The Service shall not be liable for any damages incurred by Users in connection with the use of the Service, except in cases of willful misconduct or gross negligence by the Service.

Article 13 (Restriction and Termination)

If a User violates these Terms, the Service may, without prior notice, restrict use or terminate registration for that User.

Article 14 (Changes to Terms)

The Service may change these Terms at any time without prior notice to Users when deemed necessary. The revised Terms become effective when posted on this page.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. In the event of disputes regarding the Service, the court having jurisdiction over the operator's location shall have exclusive jurisdiction as the court of first instance.
